Bankruptcy and Creditors' Rights Print E-mail

The attorneys at Cohn Lifland strive to protect the interests of their clients who need preservation and enforcement of their rights as creditors. We advise banks and other financial institutions of their rights and remedies in bankruptcy, foreclosures and various types of recovery of real and personal property, secured transactions and in other areas of commercial law.

Our work ranges from sophisticated loan restructuring and workouts to consumer collections and mortgage foreclosures and includes litigation in state, federal and bankruptcy courts. In handling these types of matters, we help resolve problem and disputed loans by negotiating with debtors and their attorneys for payment plans, forbearance agreements as well as aggressive and expeditious litigation when necessary. In bankruptcy matters, we litigate to provide relief from automatic stays, to establish plan structures for reorganization and to resolve cash collateral disputes among other competing interests. Cohn Lifland attorneys also negotiate with debtors at all stages of bankruptcy filings regarding plan treatment and confirmation, debtor-in-possession financing and other issues. In some instances, we represent debtors who need counsel at the very crucial time before bankruptcy and during insolvency proceedings. Jeffrey W. Herrmann appears in the Bankruptcy Courts of New Jersey and other states as well as having written and lectured on bankruptcy-related subjects for both lawyers and non-lawyers.
