The Monday July 23 edition of the New Jersey Law Journal quoted Peter S. Pearlman in relation to his successful representation of the plaintiffs in In re Merck & Co., Inc. Securities, Derivative & ERISA Litigation, No. 06-2911 (see section 1B, page 23) which charges company officers and directors knew as early as 1999 that Vioxx was potentially harmful, but failed to take action. The Third U.S. Circuit Court of Appeals ruled that the U.S. District Court erred by refusing to consider new information.
