New Jersey Ignition Interlock Devices

Copy-of-Fotolia_80752093_L-768x512.jpgNew Jersey courts may require a person who has been convicted of a driving while intoxicated charge to install an ignition interlock device in his or her vehicle. These devices require the driver to take a chemical breath test each time they start the vehicle. Ignition interlock devices will record the BAC and if alcohol is detected on a driver's breath, the vehicle will not start.

Some devices require you to go to an appointment so the manufacturer of the ignition interlock device can obtain the information that has been recorded and submit it to the correct authorities. The device records BAC, how long the vehicle was running, when BAC tests were taken, and any time the device was unplugged. Any person who has been required to install an ignition interlock device will have to pay for the cost of the device as well as for the installation and removal of the product. You will only be able to obtain a device through one of New Jersey's approved manufacturers.

Drivers will be required to install an ignition interlock device for up to one year if they were charged with a first offense DWI with a BAC reading of a minimum 0.15%. Any person who has been convicted of a second driving under the influence offense will be required to install the device for up to three years after their license has been restored. Third offense driving under the influence charges also require the driver to install the device for up to three years after license restoration. In addition to having the device installed after the driver's license has been restored, the driver must also have the ignition interlock device installed throughout the time in which their driver's license is suspended.

If you have been charged with driving while intoxicated in New Jersey, you will require an experienced attorney to represent you in your case.
