New Jersey Wrongful Death Act
New Jersey enacted the Wrongful Death Act to compensate the family of a victim of a wrongful death. This lawsuit differs from other personal injury cases because the victim is not the person bringing the lawsuit. The New Jersey Wrongful Death Act allows for families of victims to recover economic damages based upon the lost earnings of the decedent, adjusting for future inflation and taking into consideration the victim’s projected earnings. Damages are calculated by multiplying the deceased earnings by the number of years before retirement, taking into account inflation.
Also, the Act allows for family members to recover for the loss of companionship. This does not mean grief or emotional stress, which cannot be recovered through the Wrongful Death Act. It relates to the monetary value of parental guidance and care provided by the victim, the value of household services provided by the victim (cleaning, babysitting, etc.,) and hospital, medical and funeral expenses of the victim. If you were at the scene of the accident, you may be able to recover damages for the emotional distress of seeing a loved one injured and killed in an accident. That claim is outside the Wrongful Death Act and is brought individually by the person who saw the accident.
