Can birth injuries be the bases for a medical malpractice case?
Oftentimes an injury may be related to something that the doctor did wrong or the doctor failed to do.
Sometimes a child can be caught and the shoulder is caught under the mother’s bones. If that is not relieved appropriately or properly, the child can develop what is called Erb’s Palsy.
There are techniques to relieve that problem and if the physician does not use those appropriate techniques, the baby is going to be injured.
Sometimes, the obstetrician isn’t acutely aware of what that monitor is showing and if that fetal distress is permitted to go on for a prolonged period of time, you can have that fetus or that child develop Cerebral Palsy.
