Protecting New Jersey Bikers After A Motorcycle Accident

The roads of New Jersey offer motorcyclists a wide variety of terrain and sites to enjoy. People from all over the tri-state area come to New Jersey to enjoy our mountain roads, beach communities and charming farmlands. However, the freedom of the open road that attracts a motorcyclist also puts them at risk.

The injuries that result from motorcycle accidents can be more severe than those from an automobile accident. When operating a motorcycle, the rider is vulnerable. Without the protection you get with other motor vehicles, a motorcyclist can sustain major injuries and death. The number of injuries and deaths from motorcycle accidents has increased drastically in the last ten years. Along with most states, New Jersey has helmet laws. Every rider in New Jersey is required to wear a helmet at all times.

PIP Coverage And Motorcycles

In most motor vehicle accident cases, automobile insurance will cover medical expenses with no regard to fault. Whether the accident was your fault or not, you are generally covered by personal injury protection. In the case of a motorcycle, it depends on the insurance provider if your medical treatment and bills will be covered under PIP. Most insurance companies do not offer PIP for riders or passengers of a motorcycle. When they do, it is optional and expensive. Most will cover a pedestrian who may be involved in a motorcycle accident, but will explicitly say that the operator or passenger is not covered.

Personal Injuries And Motorcycles

In New Jersey, when a motorcyclist gets into an accident with a private motor vehicle, the rider may be subject to the verbal threshold. The verbal threshold, or limitation on lawsuits option, limits an injured party’s ability to sue for damages. One must show evidence of a serious and permanent injury before one is eligible to recover damages. Serious injuries include dismemberment, loss of a fetus, significant disfigurement, displaced fracture or permanent injury (within a reasonable degree of medical probability). It is important to note that personal injury lawsuits must be filed within two years of the accident under New Jersey’s Statute of Limitations.
