What an attorney may ask for after an accident with a truck

On behalf of Cohn Lifland Pearlman Herrmann & Knopf LLP | Aug 7, 2018 |

Many news stories about Labor Day weekend focus on auto safety. This is understandable given that millions of people will be driving to their favorite vacation destinations over the next few days. But with semi-trucks on the road, avoiding staying out of truck accidents must remain a priority.

Due to the size difference between passenger cars and trucks, an accident between the two can cause significant traumatic injuries. If you have the misfortune of being in such an accident, hiring an experienced attorney can be helpful in securing a recovery. The attorney will need some important pieces of information. This post highlights a few of them.

Information about the trucking company — To begin with, your lawyer will need to learn as much as possible about the trucking company involved in the crash, and whether the driver was an employee or an independent contractor. If you don’t have this information, do not be concerned. Researching this information is part of what an experienced personal injury attorney does to develop a case.

Was there any video of the crash? — While there may be eyewitnesses to the accident, memories may fade quickly or may not be reliable given the trauma involved. Video footage is very helpful in establishing fault. Your attorney will want to know if you have pictures or video of the accident, whether it is through a cell phone or a dashboard camera or whether any independent video cameras recorded the accident.

Your medical condition after the accident — Your attorney will also want to know the extent of your injuries and what your prognosis is for recovery. Again, this information may not be readily available, but your attorney will have you sign releases to obtain this information.

We want to reiterate that you don’t have to be severely injured to learn about your rights and options after truck accident. We stand ready to answer your questions.
